As conditions for membership, you agree to the following:

All members of the Cigar Banner Exchange Network are required to agree to the following Terms and Conditions. Anyone determined by Cigar Banner Exchange Network (CBE) to have violated these terms and conditions is subject to being banned from CBE without any obligation by CBE to redeem any earned credits. Any dispute will be resolved by Cigar Banner Exchange. We have a very small staff, so please understand that our decision is final and not open to debate. This is a FREE service to help Cigar, Dinner & Wine web sites promote their web sites for no cost.

Your web site must be a related to products, services and/or news concerning Cigars, Tobacco, Food and/or Drinks. Evidence of that must be displayed on the MAIN PAGE of the web site registered on your account or ONE-LEVEL DEEP. "One-level deep" means that from the main page, we can click a link to a sub-page on the web site and see that this is a Cigar related web site. We should be able to see pretty quickly that we are on a Cigar web site. We WILL NOT go down beyond the first-level or "hunt around" to determine if your web site qualifies.

The URL you register for your CBE account (or a page that is "one-level deep" from the main page) MUST have a CBE banner. You may have CBE banners on other pages through out the web site, but when a visitor clicks on your banner from another CBE member site, they must arrive on the page (or a page "one-level deep" from the main page) that displays a CBE banner.

Your CBE account MUST NOT be used on a web site other than the one registered in your account. You may open up another account for another web site. In other words, you may not apply your CBE banner code on a high-traffic site to promote a low-traffic site.

Members agree to include the full HTML code provided by CBE for displaying banner ads on their web site, and may not modify it in any way except to accommodate text color, font, or for the accommodation of frames. Members must display banners on at least one page accessible by the viewing public. Otherwise Members may display banners on as many, or few pages as they wish for additional banner exposure. CBE reserves the right to verify the placement and correctness of its HTML code through any means.

Members acknowledge that CBE is a free service supported by sponsors. At any given time, the banner on a member's web site may contain an advertisement from a sponsor, from another member, or from the CBE.

You understand that you must supply a banner to CBE. It must be a .GIF, file format. The physical dimensions must be 468 x 60 pixels only. It must be 12K in size or less. It may be animated. If you have trouble getting your graphic down below the specified size, please read the tips in the FAQs page. We can help in many situations on reducing the file size.

You understand that after opening your account, there is a waiting period of up to 48 hours before ACTIVATION. Your account will be activated after we verify your web site and your banner, verify that the CBE banner has been installed on your web page, and check to see that you are in agreement and compliance of these Terms & Conditions. If we cannot activate your account for any reason, you agree to comply with our requests for any changes to your account information, web site, or banner, within 7 days. Otherwise, your UNACTIVATED account will be canceled. If you have trouble submitting your banner, please e-mail us with your banner as a file attachment and we will upload it for you.

You understand that you gain 1/2 a credit (2:1) each time a CBE member banner is displayed on YOUR site. And that YOUR banner is displayed on another member's web site each time you gain ONE full credit. When a member site's banner cannot be displayed, you understand that a banner promoting Cigar Banner Exchange or one of our paid sponsors will display.

CBE reserves the right to deactivate accounts for web sites that display an inordinate number of banners for or links to competing banner exchange services, sites that contain little or no original content, and sites where CBE banners appear on an inordinate number of dynamically-generated pages.

A member may not artificially inflate traffic counts to his/her site using a device, program, or other means. A member may not include the banner on any page that automatically reloads or goes to another page without interaction from the user, or on a page which is inaccessible to the general surfing population. A member may not place his/her Cigar Banner Exchange HTML code on pages that are unrelated to the site being advertised. Anyone found in violation of these policies will be banned from the Cigar Banner Exchange.

The following types of sites are NOT allowed to participate in the CBE: Sites containing sexual and/or pornographic material, sites with links to pornographic sites, sites encouraging illegal activity or racism, sites providing instructions or discussions about performing illegal activities, sites engaged in libelous or harassing activities, sites that promote or utilize software or services designed to deliver unsolicited e-mail, sites that are otherwise inappropriate.

Cigar Banner Exchange Network reserves the right, in its sole discretion, to determine whether sites may participate in CBE Network.

CBE retains ownership and all rights to the Cigar Banner Exchange Network name, cigarbannerexchange.com, cigarbanners.com, cigarbanner.com, logo, software, databases, reports, web site, and information.

CBE reserves the right to restrict the use of its name, system, logo, software, lists, databases, reports, and any information created or obtained by CBE. However, each individual web site has the right to use information obtained by CBE on the site or in the promotion of the site.

Members acknowledge and agree that their web site information may be utilized by CBE. Possible uses include lists of the busiest sites, top ten ranking sites, lists of member sites, etc. Under no circumstance does CBE sell, trade or exchange information on it's members with outside sources.

All members agree to utilize the services of CBE at their own risk. CBE, its administrators, partners and sponsors cannot be held liable for any damage or loss of information that may occur from the use of the services of CBE.

Although we will make a reasonable effort to provide a high standard of quality for our services, CBE makes no guarantees of any kind regarding the dependability, accuracy, or timeliness of the services provided.

The information provided by CBE to members may be proprietary in nature. Members acknowledge that they are not competitors of CBE, and agree not to share this information with any competitors.

Anyone found in deliberate violation of these terms and conditions is subject to being banned from CBE Network.

You agree to defend, indemnify and hold Cigar Banner Exchange Network harmless from and against any and all claims, losses, liability costs and expenses (including but not limited to attorneys' fees) arising from your violation of this Agreement or any third-party's rights, including but not limited to infringement of any copyright, violation of any proprietary right and invasion of any privacy rights.

This obligation will survive any termination of this Agreement.
